Scenario 23 — Labour rights in practice: contracts, pay, leave, OHS (180’)

IMPORTANT: This is an educational workshop, not legal advice. Regulations and rates change — participants should verify current information in official sources (employer, PIP/National Labour Inspectorate, ZUS, university/office). We use fictional data in exercises.

1. Overall goal and session logic

Objective: participants understand the differences between forms of cooperation (employment contract, mandate contract, contract for specific work, B2B), can check key elements of a contract, read a payslip / keep time records, know the basics of leave/absence as well as OHS and how to respond to irregularities; they prepare 4 short letters to an employer and a 30‑day plan.

Logic: forms map → contract and red flags → pay/time → leave/absence → OHS and response → letters and plan.

Final outputs: 1) PRW1 — Map of cooperation forms (employment/mandate/specific work/B2B), 2) PRW2 — Contract checklist and “red flags”, 3) PRW3 — Pay: payslip/time records (template), 4) PRW4 — Leave and absences: decision tree + requests (templates), 5) PRW5 — OHS and responding: checklist + accident procedure, 6) PRW6 — Case studies for role‑plays (recruitment/contract/overtime/discrimination), 7) PRW7 — Letters to an employer (A2–B2: 4 templates), 8) PRW8 — Support map (internal/external), 9) PRW9 — 30‑day plan (3 actions + contacts), 10) PRW‑R — Skills assessment rubric.

2. Learning outcomes (knowledge • skills • attitudes)

Knowledge: knows the differences between the main forms of cooperation (parties, purpose, liability, entitlements), the elements of a written contract, general rules of pay and working time, the basics of leave/absence, the role of OHS and equal opportunities (anti‑discrimination/mobbing).
Skills:

selects the appropriate form for a situation (PRW1);

checks a contract using the checklist (PRW2);

reads a payslip / keeps time records (PRW3);

fills in leave/absence requests (PRW4);

applies basic OHS and the accident procedure (PRW5);

writes 4 short letters and prepares a 30‑day plan.
Attitudes: insisting on a written contract, safety > speed, the right to ask questions and to be treated fairly.

28–63’ MODULE 1 — Forms of cooperation and “what works when” (35’)
  • Objective: choose the right form and know what to expect. Materials: PRW1 (map). Instructions:
  • Employment contract: subordination, place and working time, leave, OHS, time records; pay at least once a month; employee documentation.
  • Mandate contract: due diligence / best efforts, more flexible time/place; benefits and insurance depend on the terms — check the contract; time records (often).
  • Contract for specific work: result‑based, no time records, usually without insurance — check regulations and practice.
  • B2B: company‑to‑company relationship; invoice; your own insurance/taxes; greater independence and risk (bridge to scenario 18). Exercise (15’): 6 cases → match the form + why (PRW1). Criterion: at least 5/6 correct matches with justification.
63–93’ MODULE 2 — Contract and red flags + payslip / time records (30’)
  • Objective: check documents and understand pay/time. Materials: PRW2, PRW3, payslip/time‑records mock‑ups. Instructions:
  • PRW2 — contract checklist: parties and data, position/scope, place and working time, pay (method and date), term, leave/benefits (if applicable), medical exams/OHS training, signatures/attachments. Red flags: no written contract before work, “we pay cash without payslips”, deductions without consent/explanation, pressure not to read the contract, oral agreements conflicting with the written one.
  • PRW3 — pay/time:
  • Payslip (mock‑up): components (base, bonuses/allowances), deductions (contributions/tax), amount to be paid; no real numbers.
  • Time records: working hours, overtime, breaks, night work; basics of settlement in line with the contract; for mandate contracts — confirming hours. Exercise (12’): check the contract mock‑up using PRW2 + identify 2 irregularities on the payslip/time records (PRW3). Criterion: PRW2 completed + irregularities identified.
93–103’ BREAK (10’)
103–128’ MODULE 3 — Leave and absences: decision tree (25’)
  • Objective: know the pathway and documents. Materials: PRW4 (decision tree + templates). Instructions: overview: annual leave (planning/request), occasional/on‑demand leave (notification), sick leave (L4/e‑ZLA), childcare leave (if applicable), assignment to training; for mandate/specific‑work contracts — entitlements depend on clauses/agreements. Exercise (12’): 4 mini‑cases → choose the branch of the tree and fill in the appropriate request (PRW4). Criterion: correct match of absence type and a complete request.
128–153’ MODULE 4 — OHS and equal treatment: responding (25’)
  • Objective: act safely and with respect. Materials: PRW5 (OHS + accident procedure), PRW6 (role cards). Instructions:
  • OHS: initial/periodic training, protective equipment (PPE), reporting hazards; accident: first aid → secure the area → report → documentation.
  • Equal treatment: microaggressions, discrimination, mobbing — internal routes (supervisor/HR/OHS officer) and external (institutions/NGOs — see PRW8); bridge to scenario 16 (5D bystander intervention). Role‑play (12’): choose 1 case from PRW6 (e.g., joke about accent, no gloves despite reporting, being told to work without training) → prepare an I‑message/DESC statement + an OHS report (PRW5). Criterion: statement prepared and a draft report filled in.
153–175’ MODULE 5 — Letters to an employer (A2–B2) (22’)
  • Objective: write briefly and effectively. Materials: PRW7 (4 templates): A) Request for a written contract / before starting work; B) Leave request; C) Request to clarify pay/payslip elements; D) Report of OHS irregularities/discrimination. Instructions: in groups of four, each person writes 1 letter (max 12 sentences); exchange and quality check using PRW2/PRW5. Criterion: 4 correct drafts (plain language, no judgments, with dates and attachments).
175–180’ Mentimeter POST + closing (5’)
  • Objective: closure and implementation. Instructions: POST (same 3 questions). On PRW9 write 3 steps/30 days (e.g., “I will ask for a written contract”, “I will check my payslip using the checklist”, “I will review OHS at my workplace”).

6. Good facilitation practices

Plain language (A2–B2): short sentences, pictograms; explain terms.

Safety and confidentiality: do not discuss individual disputes; direct participants to official procedures and support (PRW8).

Documents: keep copies, dates, confirmations.

Bridges: scenario 03 (assertiveness/DESC), 14 (budget), 16 (anti‑discrimination), 18 (B2B), 15 (document cybersecurity).

7. Adaptations, plan B, variants

Language barrier: A2–B2 letter templates with PL↔UA phrases; mixed‑language pairs.

Small group (≤10): more 1:1 work on contracts/letters; simulate conversations with HR.

Less time (120’): M1 25’, M2 25’, M3 20’, M4 20’, M5 20’; PRW9 as homework.

More time (+30’): add a module “meeting with an OHS/HR officer” (Q&A) or a review of contract templates.
